The Prosecutors who liked to see DeLay in jail immediately wanted him at least ten years in prison. Tom stated in the court prior that, he fought the fight, ran the race and kept the faith. He added that he did nothing wrong, the prosecution was motivated politically and he never intended to break the law.

The Senior Judge Pat Priest stated that, he does not agree that the Travis County District Attorney's Office has picked on Tom DeLay to persecute.
